By accessing or using the Viridian Dynamics REF Portal at viridiandynamics.com.au ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including applicants, administrators, and visitors.

2. Services Provided

Viridian Dynamics provides an online platform for the submission, management, and preparation of Review of Environmental Factors (REF) documents for hazard reduction and fuel management activities in New South Wales. Our services include:

• Online REF application submission and management
• Professional REF document preparation by qualified environmental practitioners
• Threatened species and Aboriginal heritage assessment services
• GIS mapping and spatial analysis services

3. User Accounts

You must create an account to submit REF applications. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and complete information in your applications
• Notifying us immediately of any unauthorised use of your account

4. Accuracy of Information

You warrant that all information submitted through the Platform is accurate, complete, and not misleading. Viridian Dynamics prepares REF documents based on the information you provide. We accept no liability for REF documents prepared on the basis of inaccurate or incomplete information supplied by the applicant. It is your responsibility to ensure site details, proposed activities, and environmental data are correct before submission.

5. Professional Advice Disclaimer

REF documents prepared by Viridian Dynamics represent our professional assessment based on information provided. They do not constitute legal advice. Regulatory approval of any activity remains subject to the assessment of the relevant determining authority under the Environmental Planning & Assessment Act 1979 and other applicable legislation. Viridian Dynamics does not guarantee regulatory approval of any project.

6. Payment and Fees

Fees for REF preparation and related services will be communicated to you prior to commencement of work. Payment terms will be set out in a separate service agreement or quote. The Platform itself is provided at no cost for submission purposes; professional service fees apply to REF document preparation.

7. Intellectual Property

REF documents prepared by Viridian Dynamics are provided for your use in connection with the specific project described in your application. All professional content, templates, and methodology embodied in our REF documents remain the intellectual property of Viridian Dynamics. You may not resell, redistribute, or adapt our work product for use on other projects without our written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Viridian Dynamics is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or our services, including but not limited to loss of profit, loss of data, or regulatory delays. Our total liability for any claim arising under these Terms is limited to the fees paid by you for the specific service giving rise to the claim.

9. Termination

We reserve the right to suspend or terminate your account if you breach these Terms, provide false information, or use the Platform for any unlawful purpose. You may close your account at any time by contacting us. Termination does not affect any outstanding obligations or completed service agreements.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Platform after updated Terms take effect constitutes your acceptance of the new Terms.
